Major Legal Shift: Communities Can Now Block Tourist Rentals

Starting April 3, 2025, homeowners’ associations (HOAs) can legally prohibit or limit tourist rentals in apartment buildings — a game-changer for many owners.

Under Organic Law 1/2025:

  • A 3/5 vote by residents (based on participation quotas) can block or restrict tourist activity in the building.

  • If you rent without this approval, the community can take legal action to stop you.

  • They can also charge up to 20% more in community fees to owners renting without permission.

National Tourist Rental Registry: Mandatory from July 1, 2025

Spain is launching a new centralized registry for all short-term rentals — part of a major effort to enforce transparency and legal compliance.

  • Every property must register through the new Digital One-Stop Shop (Ventanilla Única Digital).

  • You'll receive a Unique Registration Number (NRU).

  • This number must be shown in all your listings (Airbnb, Booking, Vrbo, etc.).

  • Rental platforms must remove unregistered listings within 48 hours or face fines.
